Defending against a DUI claim

In Georgia, generally, there are two ways you can be convicted of DUI. The state must prove the driver had an 0.08 grams or more blood alcohol concentration within 3 hours, during or after, driving or otherwise being in control of a motor vehicle – this is known as a “per se” violation. The state may also prove DUI by showing the driver was “less safe” to drive a motor vehicle because of the effects of alcohol and/or other intoxicants – this is known as a “less safe” violation.

The penalties for a first offense DUI can include:

  • 10 days to 12 months in jail
  • Up to $1,000 fine
  • 12 months probation
  • 12 month long suspension of your driver’s license
  • 40 hours of community service
  • DUI defensive driving school
  • Alcohol evaluation and treatment, if necessary

Georgia courts are strict when it comes to DUI sentencing, even for a first offense. If you are convicted, the judge must comply with statutory sentencing guidelines which often make life difficult.

Underage and multiple DUIs present different challenges. We will test, question and attack every link in the prosecution’s chain of facts and argument. If your rights were violated at any time, we will expose the injustice and seek proper legal remedy, which may include dismissal, reduction to lesser charges or favorable consideration in a negotiated disposition.

At M. Qader A. Baig & Associates, LLC, if your case doesn’t go to trial, we won’t charge you the full rate. We only charge for the services we provide.
