In Georgia, an unmarried father is not presumed to be the legal father of a child until an "order of legitimation" is obtained. Before a father can pursue custody or visitation rights, paternity must be established.

Even if an unmarried father is named on the child's birth certificate, he is not legally the father until an order of legitimation is obtained. If both parents agree on the identity of the child's father, obtaining an order of legitimation is easier. In a marriage, the husband is presumed to be the legal father of the child.
